OKLAHOMA DUI ATTORNEY
Daniel R. Bays
The most frequent question I get after, "am I going to jail?" is "am I going to lose my license?" The answer is very complicated but in the end it depends on the facts and how hard your lawyer is going to fight for you. When you are arrested for DUI you will be served with a long, white piece of paper called a "notice of revocation" which puts you on notice that your license will be suspended for a period of 180 days (six months) if you do not request an administrative hearing.
If you come to BAYS LAW
These hearings will be held at DPS in
Everything comes out at these hearings and they can last a long time (often surprising to the officers). If we win your hearing, your license will be returned. If we lose the hearing and the hearing officer decides that the revocation should be sustained, an Order of Revocation will be mailed to you which will effectively suspend your license for 180 days.
Even if we lose the hearing, the fight continues on! We can appeal the Order of Revocation to the District Court in the county in which you were arrested. You will need to be present for that hearing. At that hearing, the Judge of the District Court can either return full driving privileges or you will be given a modified license which I described earlier. You will have to install a breath machine and pay for the service.
